There is no involvement by Trade Mart-India.com in the actual transaction between the two module buyer/seller .The company has no control over the safety, quality, and legality of the items that are being advertised. The certainty and accuracy of the listing the actual ability of the module that is ability of buyer to buy the item or ability of item to actually sell and so on. It is hereby pointed out that there are risks in dealing with people whom you don’t know and that Trade Mart-India has no control over such risks, the user is bound to take such risks and the result of taking such risk is phenomenal.
Since we are not in the picture during the transaction between buyer and seller it is requested to release Trade Mart-India, its agents and employees and affiliates from all refunds or warranties, claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with listings, completed or in completed transactions, or items offered or actually sold.

The user must be at least 18 years of age and possess the legal authority to enter into this network and to use the Services in accordance with all terms and conditions mentioned herein.
 You agree to be financially responsible for all of your use of the network (as well as for use of your account by others, including without limitation minors living with you). The user You also warrant that all information supplied by you or members of your business and/or household in using the Services, including without limitation your name, e-mail address, street address, telephone number, credit card number(when required), and if you are selling goods, all information about your listed goods, is true and accurate. By clicking "Agree" you certify that you are 18 years of age or older and legitimate agent for the party for whom you claim to represent.
The user is said to be warranted that the user will abide by all additional procedures and guidelines, as modified from time to time, in connection with your use of the services. You further guarantee that you will comply with all applicable laws and regulations regarding use of the services.
When you list the items for sale, you warrant that you have the legal right to sell the item. As a seller, you are warranted the item to sell and list the item in right category. To sell multiple items, you must list identical items (this means that same features should be listed closely).

It is the responsibility of the user to determine whether the purchase or sale of any mentioned item is authorized by law, statute or regulation. Without limitation, the following items may not be sold or offered for sale on the TradeMart-india.com market places: firearms, explosives, and ammunition; alcoholic beverages (except if you are reselling an alcoholic beverage that was initially purchased from a retailer and is still in its original container and it is legal to deliver into the jurisdiction where the buyer lives); tobacco products; food that is not packaged or does not comply with all applicable laws for sale to consumers by commercial merchants; pharmaceuticals and controlled substances; counterfeit, pirated or stolen goods; any goods that infringe or otherwise violate another party rights, including copyright, patent, trademark, and rights of publicity and privacy; goods that are, in TradeMart-india.com discretion, indecent, obscene or pornographic; registered or unregistered securities; goods which you do not have the legal right to sell; goods which are misrepresented or which do not in fact exist; goods which, if sold via the Services, would cause TradeMart-india.com to violate any law, statute or regulation.
TradeMart-india.com reserves the right to cancel any listing at any time, and reserves the right to prohibit or restrict access to the Services to anyone at any time, with or without cause. TradeMart-india.com reserves the right of removing the profiles of people who register with bogus addresses, telephone, and fax information.

Trademart_india.com as a B2B portal offers each of its paid advertisers an option of contacting buyers and sellers listed under various sections of tradeMart-India.com.
1400 inquiries will be maximum inquiries in the period of one year(365 days from the date of hosting of their companies advertisement)an advertiser can send.
These inquiries can be sent by user any time of year within the stipulated time duration.
As a seller on TradeMart-india.com, you agree that users may comment on their experiences with you in the Feedback section of TradeMart-india.com and you release TradeMart-india.com and its users from any liability for any comments.

Trade Lead Ratings
Trade Mart-India encourages users to rate the companies they do business with on this Ecommerce, e-marketplace. The actual responses (positive or negative) that users receive while transacting with various parties are the trade lead ratings.

Buyers rate sellers on service and product quality. In turn, sellers rate buyers based on ease of transaction, timely payments etc. The following points should be considered when rating a Trade lead.

a) Abuse of trade lead rating system is prohibited, that includes using the user id of another user or your own secondary user ids to raise your own Trade lead rating or lower the rating of another Trade lead member; or the use of threatening, abusive, racially defamatory, discriminatory or profane language. If your language is in any way offensive, the offended user can file legal proceedings against you and you will be held liable for your comment.

b) The company has the right to delete any rating without prior notice and/or at its sole discretion upon an investigation into the rating. The ratings system promotes freedom of expression on TradeMart-india, however we encourage users to rate other users singularly based on their experiences while transacting business. We remove users’ feedback only in exceptional circumstances.

c)  Trade Mart-India may also caution users transacting with buyers and sellers who have been suspended. TradeMart-india reserves the right to suspend and reactivate any user id depending on negative or positive ratings of the particular user.
 TradeMart-india may also caution users transacting with buyers/sellers who have been suspended. Once a user is suspended, all live Trade leads of that user will be closed and Trade leads that are loaded shall be deleted as well.

d) If you feel that you have received an unfair rating or you have evidence of any abuse of the rating system, please contact us.

e) TradeMart-india under any circumstances will never be held liable for any Trade lead Rating. You agree not to interfere with TradeMart-india.com market places. You agree not to put any material into TradeMart-india.com systems which contains any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate any system, data or personal information. You are solely responsible for actions taken under your password, and should not disclose it to anyone else. You cannot use your password for any unauthorized purpose.

 

TRUST STAMP

Since the verification of users in internet is quite difficult, Trade Mart-India cannot confirm each user’s identity. For the comfort of users TradeMart-india offers trust stamp tool which provides users with more authentic information about the listed company (wherever applicable). We encourage users to use trust stamp tool available on site, as well as business sense, to evaluate with whom you are dealing. In no event shall TradeMart-india.com be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever with respect to the offered tool & the contents. Users of the site must hereby acknowledge that any reliance upon any content shall be at their sole risk.

LICENSE
By clicking “Agree” you give us a non exclusive, world wide, royalty free, irreversible License to reproduce, display, transmit, modify, make derivative works from, (each in any manner), in any existing or future media, known or unknown, the material displayed in your listings.
No Resale or Unauthorized Commercial Use.
You agree not to make any unauthorized commercial use of TradeMart-india.com
 You also agree not to resell or assign your rights or obligations under these terms and conditions.

OTHERS' INFORMATION
You agree not to make use of anyone else's information concerning TradeMart-india.com market places other than as necessary to participate in TradeMart-india.com and to complete any transactions in which you are involved

OWNERSHIP OF DATA
While participating in any TradeMart-India.com network information about yourself/products must be provided.  Exclusive rights have been granted to Trade Mart-India all of this information, and all content generated from it, in all existing future media. These rights include but are not limited to the right to display your information anywhere on TradeMart-india.com services and media properties, to search the information, and, consistent with our privacy policy, to repackage and resell it to anyone for any reason. As used in this paragraph, information includes but is not limited to data, text, photographs, drawings, sound recordings, feedback, and any other information or data displayed or presented in connection with your listings on TradeMart-india.com.

TradeMart-india.com's RIGHTS TO TERMINATE

You agree that TradeMart-india.com, in its sole discretion, may terminate any use of the Service/delete the listing immediately and without prior notice.

 

AGENCY
There is no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between TradeMart-india.com and any user of the Service.

FALSE INFORMATION
If TradeMart.India.com finds that the information entered by the user in registration or web mail is false the company reserves the right to terminate the user’s account.

LAW SUIT
As mentioned above the terms and conditions and the relationship between the User and TradeMart-india.com Service shall be governed by the laws of the State of Delhi without regard to its conflict of law provisions. The User and TradeMart-india.com agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Delhi, India

THE AGREEMENT
The User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of TradeMart-india.com Service or these terms and conditions must be filed within one (1) year after such claim or cause of action shall arise or be forever barred.
